# Tariffs Moved From Emergency Powers to the Statute Book, and That Changes Who Carries the Risk

On February 20 the Supreme Court held that the International Emergency Economic Powers Act does not authorize the president to impose tariffs, striking down both the reciprocal tariffs and the trafficking-related duties on Canada, Mexico and China. The temporary 10% import surcharge that replaced them ran under Section 122 of the Trade Act, which carries a hard 150-day limit, and it expired on July 24.  
  
Trade policy did not go away when those tools did. It moved into narrower statutes that work differently, apply to specific goods rather than to whole countries, and take months of administrative process rather than a single signature. For investors, that is a change in where tariff risk sits, not a reduction in it.

### Broad country tariffs gave way to sector investigations

The authorities still standing are Section 232 of the Trade Expansion Act, which covers imports deemed a national security threat, Section 301 of the Trade Act, aimed at unfair foreign practices, and Section 338 of the Tariff Act, which responds to discrimination against US commerce. Section 232 has already been applied to steel, aluminum, copper and automobiles, with semiconductors and pharmaceuticals under active investigation.  
  
The practical difference is targeting. An across-the-board surcharge is a broad tax on imported inputs that spreads thinly through almost every supply chain. A Section 232 action on a single product category is concentrated, and it lands on identifiable industries with identifiable competitors. Domestic producers in a protected category gain pricing power. Downstream manufacturers who buy that input absorb the cost.  
  
There is also a slower rhythm to it. These statutes require investigations, findings and comment periods, which means the market usually gets warning that a sector is being examined well before duties appear. That is a meaningful contrast with the past two years, when the tariff schedule could change overnight.

### Congress and the courts are both back in the picture

**Whitmore's Watchlist:** 
**NUE** (Nucor Corporation): A domestic steel producer, the clearest beneficiary of Section 232 duties staying in place on metals.  
**SOXX** (iShares Semiconductor ETF): Semiconductors sit inside an open Section 232 investigation, which makes the sector a live policy exposure rather than a settled one.  
**FXI** (iShares China Large-Cap ETF): Direct exposure to the market most affected by the widening outbound investment restrictions.

Senator Ron Wyden introduced legislation on July 22 that would repeal Section 122 outright and require congressional approval for future actions under Sections 301, 201 and 232\. Whether or not it advances, its existence tells you the direction of travel: after a court took one authority away, the legislature is testing whether it can constrain the rest.  
  
Capital flows are moving the same way. The FY26 National Defense Authorization Act folded in the COINS Act, extending outbound investment restrictions beyond China to Cuba, Iran, North Korea, Russia and Venezuela. That is trade policy reaching into portfolio allocation rather than only into shipping containers.  
  
The unfinished business is refunds. The Court acknowledged that IEEPA duties already paid are subject to reimbursement without specifying how, and the mechanics are working through the lower courts now. Importers who paid those duties are carrying a receivable of genuinely uncertain size and timing, which is worth remembering when reading margin guidance from retailers and industrial distributors.

### The risk did not shrink, it relocated

For a diversified portfolio, the shift argues for looking at policy exposure by sector rather than by country. A fund built around emerging market breadth was the natural hedge against blanket tariffs. It is close to irrelevant against a semiconductor-specific finding.  
  
It also changes how much warning the market gets. Under emergency authority, the only reliable way to manage tariff risk was to hold less of whatever might be hit. Under the current statutes, an investigation is public, the product scope is published, and the interval between the notice and the duty is usually measured in months. That is time to read the filings of the companies you own and see who has already contracted around the exposure.  
  
The other lesson is about duration of policy. Emergency authority can be withdrawn by a court in a single ruling. Statutory tariffs, once imposed through the proper process, tend to outlive the administration that imposed them, because unwinding them requires the same procedural machinery that created them.  
  
**Whitmore's Take**: The headline risk of a surprise tariff announcement has fallen and the durability of the tariffs that do get imposed has risen. Worth checking whether the companies you own buy the inputs now under investigation, or sell them.
